Terms At A Glance

Before using Litera, please read the full Terms. In summary: you receive limited digital access, not ownership of any book or file; purchases and subscriptions are tied to your account and applicable access rules; copying, sharing, scraping, bypassing controls, unauthorized AI use, review manipulation, harassment, and other misuse are prohibited; refunds are limited and assessed under Section 10 and applicable law; content and features may change when rights, technical, legal, or operational circumstances require it; and Litera may restrict or terminate access for violations. This summary is for convenience only. The complete Terms below control.

Welcome to Litera PH. These Terms of Use (“Terms”) govern your access to and use of the Litera PH website, platform, reader, content, services, features, accounts, subscriptions, digital titles, community programs, and related services (collectively, the “Platform”).

By creating an account, accessing the Platform, reading content, purchasing a title, subscribing to a plan, using Third Places access, or otherwise using Litera, you agree to these Terms. If you do not agree to these Terms, you must not access or use the Platform.

1. About Litera

Litera PH is a Filipino digital reading platform built to make local literature easier to discover, access, and support through modern digital infrastructure. Litera provides access to Filipino digital titles through one or more access models, including individual purchases, subscriptions, free accounts, promotional access, institutional access, Third Places premises-based access, and other programs approved by Litera.

Litera is not an open file repository. Content available on the Platform is provided through controlled digital access and remains subject to author rights, publisher rights, platform rules, and applicable laws.

2. Eligibility

You must be at least 18 years old to create an account or purchase, subscribe, or enter into transactions on Litera without parental or guardian involvement. Users below 18 years old may use Litera only with the consent and supervision of a parent or legal guardian.

Litera may refuse registration, suspend access, or terminate accounts if it determines that a user is not eligible, has provided false information, or has used the Platform in violation of these Terms.

3. Account Registration

To access certain features, you may be required to create a Litera account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must not:

  1. a.Create an account using false or misleading information;
  2. b.Impersonate another person or organization;
  3. c.Share your account credentials with others;
  4. d.Sell, transfer, sublicense, or assign your account;
  5. e.Use another user’s account without permission;
  6. f.Create multiple accounts to abuse promotions, access rules, or platform systems; or
  7. g.g. Use automated systems, bots, scripts, or scraping tools to create or access accounts.

You must notify Litera promptly if you believe your account has been compromised.

4. Platform Access and License

Subject to these Terms, Litera grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for lawful personal reading, discovery, and related purposes. This license does not transfer ownership of any content, book, file, software, platform feature, intellectual property, or data to you.

You may use Litera only in accordance with these Terms, Litera’s policies, applicable laws, and any specific access rules tied to your account, purchase, subscription, partner location, or program.

5. Digital Content Access

Litera may provide access to digital content through different models, including:

  1. a.Free account access;
  2. b.Individual ebook or digital title purchase;
  3. c.Subscription access;
  4. d.Featured title access;
  5. e.Promotional access;
  6. f.Third Places premises-based access;
  7. g.Library, school, institutional, or partner access;
  8. h.StoryCard or QR-based access; and
  9. i.Other Litera-approved access models.

The availability of any title, author, format, category, collection, or feature may change at any time. Litera may add, remove, rotate, suspend, or restrict content due to rights, author agreements, publisher arrangements, technical issues, editorial decisions, operational requirements, legal concerns, or platform policies. Access to a title does not mean you own the copyright, file, or underlying intellectual property in that title.

6. Individual Purchases

Where Litera allows individual title purchases, a purchase grants you access to the purchased title through your Litera account, subject to these Terms and any applicable platform rules.

Unless otherwise stated by Litera, individual purchases are for personal reading access only. You may not download, copy, reproduce, redistribute, resell, sublicense, transfer, scrape, extract, or publicly display purchased content except as expressly permitted by Litera.

Litera may restrict, suspend, or remove access if payment fails, a transaction is reversed, a refund is issued, fraud is detected, rights become unavailable, or the account violates these Terms.

7. Subscriptions

Litera may offer subscription plans that provide access to selected titles, featured titles, collections, or platform features during the active subscription period. Subscription access is not ownership. It is a time-bound access right tied to the active subscription, applicable plan rules, and Litera’s available content library.

Subscription content may change from time to time. Litera does not guarantee that any specific title, author, category, or collection will remain available for the entire subscription period. If a subscription expires, is cancelled, fails payment, is refunded, or is terminated, access to subscription-only content may end.

8. Payments

Payments on Litera may be processed through third-party payment providers, banks, wallets, card processors, subscription processors, or other payment channels supported by Litera. By making a payment, you agree to provide accurate payment information and authorize the applicable payment processor to process the transaction.

Litera may rely on third-party payment providers to process payment information. Litera does not control all payment processing systems and is not responsible for errors, downtime, rejected payments, unauthorized charges, processor restrictions, banking delays, wallet issues, or third-party payment failures outside Litera’s reasonable control. Prices, access models, promotions, and payment methods may change at Litera’s discretion.

9. Taxes, Fees, and Deductions

Prices may be inclusive or exclusive of taxes, gateway fees, platform fees, or other charges depending on the payment method, jurisdiction, promotion, product, or access model. Litera may adjust pricing, fees, or access terms where required by taxes, payment processor charges, currency conversion, card fees, regulatory requirements, or operational changes.

10. Refunds

All purchases and subscription payments are subject to applicable law, Litera’s published refund rules, and the rules of the relevant payment processor. Because Litera provides digital access, refunds are generally not available after the purchased title or subscription benefit has been materially accessed or consumed, except where required by law or where Litera determines that a refund is justified.

Litera may approve a full or partial refund, account credit, replacement access, or other reasonable remedy in cases including, but not limited to: duplicate or clearly erroneous charges; payment collected without the corresponding access being delivered; prolonged technical failure attributable to Litera that materially prevents use; a title being removed or becoming unavailable shortly after purchase before meaningful access occurred; an unauthorized transaction reported promptly and supported by reasonable evidence; or another circumstance where applicable law requires a remedy. Refunds may be denied where the content or subscription has been substantially used, the request is untimely or unsupported, the issue arises from the user’s device, connectivity, credentials, or violation of these Terms, or fraud or misuse is suspected. If a refund, reversal, chargeback, or payment failure occurs, Litera may suspend or remove the related access.

11. Third Places Premises-Based Access

Litera may provide premises-based access through approved libraries, schools, cafés, cultural centers, community hubs, or other partner locations under the Litera Third Places Program.

Third Places access is location-based. It is available only to eligible users physically present within the approved partner premises or access environment, subject to Litera’s access method and partner arrangement. Users may be required to create or log into a Litera account to access Third Places content. Third Places access does not create any right to remote, offsite, permanent, transferable, unrestricted, or personal free access outside the approved premises.

You must not share, post, distribute, sell, or circulate Third Places QR codes, venue codes, access links, login credentials, or access methods outside the approved premises unless expressly authorized by Litera. Litera may suspend, rotate, expire, replace, or restrict Third Places access methods to prevent misuse or protect the Platform.

12. Promotional Access

Litera may offer free trials, free titles, promotional access, campaign codes, sponsored access, event-based access, StoryCard access, or other limited access offers. A StoryCard or QR code is an access credential for approved digital content, not a sale or transfer of the underlying ebook file, copyright, or permanent access right. Promotional and StoryCard access may be subject to activation rules, time limits, title restrictions, quantity limits, account requirements, location rules, device or session controls, and other terms stated by Litera.

Litera may modify, revoke, limit, or end promotional access at any time if misuse, fraud, technical issues, rights issues, or operational concerns arise.

13. Reader Conduct

You agree to use Litera lawfully, respectfully, and only for its intended purposes. Prohibited conduct includes, but is not limited to, the following categories:

A. Illegal, fraudulent, or harmful activity.

Using Litera for unlawful, deceptive, abusive, threatening, harassing, discriminatory, defamatory, or otherwise harmful conduct; impersonating others; introducing malware or harmful code; or violating any applicable law or third-party right.

B. Content and rights misuse.

Copying, reproducing, extracting, distributing, publicly displaying, reselling, sublicensing, or otherwise exploiting Litera content without authorization; removing attribution or rights notices; or using content in a manner that violates author, publisher, Litera, or third-party rights.

C. Account, payment, and access abuse.

Sharing, selling, transferring, or misusing accounts, credentials, QR codes, StoryCards, venue codes, access links, subscriptions, promotions, or payment processes; creating multiple accounts to evade rules; or circumventing paywalls, location controls, account restrictions, or other access controls.

D. Technical interference and automated misuse.

Scraping, crawling, mining, harvesting, reverse engineering, decompiling, disrupting, overloading, or interfering with the Platform; using bots, scripts, emulators, browser tools, automation, or unauthorized software; or extracting content, metadata, or usage data.

E. Manipulation and community abuse.

Manipulating reading activity, engagement metrics, ratings, reviews, referrals, subscriptions, promotions, or author analytics; coordinating review bombing; posting spam; or engaging in conduct that materially harms users, authors, publishers, partners, Litera, or the literary community.

F. Unauthorized AI and machine use.

Using Litera content for unauthorized artificial intelligence training, machine learning, dataset creation, model development, automated summarization, synthetic content generation, style or voice replication, or substantially similar automated processing, including successor technologies.

14. Content Protection and Enforcement

Litera uses account-based access, reasonable technical and contractual controls, monitoring, and enforcement measures to reduce misuse and protect author and publisher content. The detailed content protection rules are set out in the Litera Content Protection Policy, which forms part of these Terms.

Where unauthorized use is detected or reasonably suspected, Litera may preserve evidence, investigate, warn users, restrict or terminate accounts, remove access privileges, disable codes or access methods, issue takedown requests, notify affected rights holders or third-party platforms, recover losses where permitted, and pursue other contractual or legal remedies. A single serious violation may justify immediate action.

No digital platform can guarantee absolute protection against screenshots, recordings, external capture, copying, or emerging methods of misuse. This limitation does not authorize prohibited conduct or reduce the user's responsibility for activity performed through the user's account, device, credentials, or access method.

15. Intellectual Property

The Platform, including its software, design, interface, trademarks, logos, text, graphics, features, databases, technology, branding, and related materials, is owned by Litera or its licensors. Digital books, stories, artworks, illustrations, covers, excerpts, and other literary or creative works made available through Litera remain owned by the relevant authors, publishers, rights holders, or licensors.

Nothing in these Terms transfers ownership of any intellectual property to you. You may not use Litera’s name, logo, trademarks, content, platform design, screenshots, branding, or materials without prior written permission, except where allowed by law or expressly authorized by Litera.

16. User Content

Litera may allow users to submit reviews, ratings, comments, messages, feedback, recommendations, profile information, reading lists, or other user-generated content. By submitting user content, you represent that you have the right to submit it and that it does not violate any law, third-party right, or Litera policy.

You grant Litera a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, store, display, reproduce, modify, adapt, publish, translate, distribute, and promote your user content in connection with the Platform, marketing, platform improvement, and Litera services. You remain responsible for your user content.

Litera may moderate, remove, hide, restrict, or refuse user content at its discretion, especially where it is unlawfully abusive, defamatory, misleading, infringing, spam, promotional, offensive, irrelevant, or harmful to the Platform or community.

17. Reviews and Ratings

Reviews and ratings must be honest, respectful, and based on genuine user experience. You must not:

  1. a.Post fake reviews or manipulate ratings;
  2. b.Review your own work using a fake account;
  3. c.Coordinate review bombing;
  4. d.Harass authors or users;
  5. e.Post spoilers without warning where spoiler controls are available;
  6. f.Use reviews for spam or unrelated promotion; or
  7. g.Post defamatory, abusive, discriminatory, or unlawful content.

Litera may remove or restrict reviews that violate these Terms.

18. Author and Publisher Content

Litera may host content submitted by authors, publishers, illustrators, or other rights holders. Litera is not responsible for verifying every statement, claim, opinion, or representation contained in every work made available on the Platform.

Authors and rights holders are responsible for the originality, rights clearance, permissions, accuracy, and legality of their submitted works, subject to their agreements with Litera. If you believe any content violates your rights or applicable law, contact Litera using the contact details in these Terms.

19. Copyright and Rights Complaints

If you believe that content on Litera infringes your copyright, trademark, privacy, publicity, moral rights, or other legal rights, you may submit a written complaint to Litera. Your complaint should include:

  1. a.Your full name and contact information;
  2. b.Identification of the work or right allegedly infringed;
  3. c.Identification of the Litera content or page involved;
  4. d.A description of the alleged infringement;
  5. e.Proof of ownership or authority to act;
  6. f.A statement that the information in your complaint is accurate; and
  7. g.Any supporting documents or links.

Litera may review the complaint, request additional information, restrict access, remove content, notify the relevant author or rights holder, or take other appropriate action. Submitting a false or misleading complaint may result in account action or legal consequences.

20. Privacy

Litera collects and processes personal data in accordance with its Privacy Policy and applicable law. By using the Platform, you acknowledge that the Privacy Policy describes Litera’s processing of account information, reading activity, transaction details, device information, access logs, support communications, and analytics information. Where consent is legally required, Litera will request it separately.

Litera may use aggregated, anonymized, or statistical data for platform improvement, author reporting, partner reporting, impact reporting, product development, marketing analysis, and operational decision- making. Litera will not intentionally disclose personally identifiable reading activity to authors, partners, or sponsors unless legally permitted, properly authorized, or disclosed in the Privacy Policy.

21. Analytics and Reading Activity

Litera may track reading activity and engagement to operate the Platform, improve recommendations, calculate author-related metrics, support royalties where applicable, detect fraud, manage subscriptions, support Third Places reporting, and improve the reader experience.

Tracked activity may include title visits, reading sessions, time spent, pages or sections accessed, completion indicators, device or browser information, location-based access signals, and other usage data. Author, partner, and sponsor reports are generally provided in aggregated, anonymized, or title-level form unless otherwise permitted by law and Litera’s policies.

22. Third-Party Services

Litera may integrate with third-party services, including payment processors, analytics providers, hosting providers, email services, authentication services, customer support tools, marketing tools, and other technology vendors. Your use of third-party services may be subject to their own terms, privacy notices, fees, availability, and policies.

Litera is not responsible for third-party service failures, interruptions, errors, security incidents, policy changes, fees, account restrictions, or actions outside Litera’s reasonable control.

23. Platform Availability

Litera aims to provide a reliable digital reading experience, but the Platform may be unavailable, interrupted, delayed, limited, or modified from time to time. Availability may be affected by maintenance, updates, hosting issues, internet outages, third-party service failures, payment processor issues, cyber incidents, security reviews, force majeure events, rights restrictions, or other operational needs.

Litera does not guarantee uninterrupted, error-free, or permanent access to the Platform or any specific content.

24. Changes to the Platform

Litera may modify, update, suspend, replace, or discontinue any part of the Platform, including features, design, pricing, access models, titles, collections, subscriptions, Third Places programs, promotions, account rules, or technical requirements. Litera may make these changes with or without prior notice, subject to applicable law and reasonable user communication where appropriate.

25. Account Suspension and Termination

Litera may suspend, restrict, or terminate your account or access if:

  1. a.You violate these Terms;
  2. b.You misuse content or access credentials;
  3. c.You engage in fraud, abuse, scraping, piracy, or unauthorized sharing;
  4. d.You fail to pay applicable charges, or a payment is reversed, refunded, or charged back;
  5. e.Litera detects abnormal, automated, or suspicious activity;
  6. f.Your account creates legal, technical, security, reputational, or rights-holder risk;
  7. g.You provide false or misleading information;
  8. h.You harass users, authors, staff, partners, or community members; or
  9. i.Litera is required or reasonably advised to do so for legal, security, or operational reasons.

You may stop using Litera at any time. Account deletion or closure may be subject to identity verification, pending transactions, legal retention requirements, fraud checks, audit obligations, or operational limitations.

26. Effect of Termination

Upon termination or suspension:

  1. a.Your right to access the Platform may end immediately;
  2. b.Access to purchased, subscription, promotional, or Third Places content may be removed or restricted;
  3. c.Litera may retain certain records as required or permitted by law;
  4. d.You remain responsible for unpaid amounts, disputes, chargebacks, or violations; and
  5. e.Provisions relating to intellectual property, content protection, payment obligations, privacy, liability, indemnity, disputes, and enforcement shall continue to apply where relevant.

27. Electronic Communications

By using Litera, you agree that Litera may communicate with you electronically, including by email, platform notifications, account messages, SMS, messaging applications, or other contact methods you provide. Electronic communications may include account notices, transaction confirmations, subscription updates, policy changes, support messages, marketing communications, security alerts, and service announcements.

You may opt out of certain marketing communications, but Litera may still send transactional, legal, security, or service-related communications.

28. No Professional Advice

Content on Litera may include fiction, poetry, essays, memoir, commentary, opinion, educational material, or creative works. Litera content is provided for reading, literary, cultural, educational, or entertainment purposes. It should not be treated as professional legal, medical, financial, psychological, tax, or other professional advice unless expressly stated by a qualified professional and independently verified.

29. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Litera disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted access, error-free operation, accuracy, completeness, availability, security, or suitability of any content.

Litera does not guarantee that:

  1. a.The Platform will always be available;
  2. b.Any specific title will remain available;
  3. c.Any content will meet your expectations;
  4. d.The Platform will be free from errors, bugs, or interruptions;
  5. e.All misuse can be prevented;
  6. f.Reading activity will always be tracked perfectly;
  7. g.Recommendations will be accurate; or
  8. h.Third-party services will function without issue.

30. Limitation of Liability

To the fullest extent permitted by law, Litera, its officers, employees, contractors, partners, service providers, licensors, and affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, data, goodwill, access, opportunity, reputation, or expected benefits.

To the fullest extent permitted by law, Litera’s total liability for any claim arising from or relating to the Platform shall not exceed the amount you paid to Litera for the specific service or transaction giving rise to the claim within the three (3) months preceding the claim, or PHP 1,000.00, whichever is lower.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

31. Indemnify

You agree to indemnify, defend, and hold harmless Litera, its officers, employees, contractors, partners, licensors, rights holders, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from or related to:

  1. a.Your use or misuse of the Platform;
  2. b.Your violation of these Terms;
  3. c.Your violation of any law or third-party right;
  4. d.Your unauthorized copying, sharing, redistribution, scraping, resale, or misuse of content;
  5. e.Your user content;
  6. f.Your payment disputes, chargebacks, or fraud; or
  7. g.Your negligence, misconduct, or unauthorized account activity.

32. Force Majeure

Litera shall not be liable for delay, interruption, failure, or inability to perform due to events beyond its reasonable control, including natural disasters, fire, flood, earthquake, typhoon, war, terrorism, civil unrest, government action, regulatory change, public health emergency, labor disruption, power failure, internet outage, cyberattack, hosting failure, payment processor failure, third-party platform failure, or other similar events.

33. Changes to These Terms

Litera may update these Terms from time to time. When changes are material, Litera may provide notice through the Platform, email, website posting, or other reasonable method. Your continued use of Litera after updated Terms take effect means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

34. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

35. Dispute Resolution

If a dispute arises between you and Litera, the parties shall first attempt to resolve the matter in good faith through written communication. You may contact Litera using the contact information below and describe the issue, relevant account details, transaction references, and supporting documents. If the dispute cannot be resolved through good faith discussions, either party may pursue remedies available under applicable law.

36. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without Litera’s prior written consent. Litera may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, transfer of assets, financing, legal compliance, or business continuation.

37. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

38. No Waiver

Litera’s failure to enforce any provision of these Terms shall not be considered a waiver of its right to enforce that provision or any other provision later.

39. Entire Agreement

These Terms, together with Litera’s Privacy Policy, refund rules, subscription terms, content guidelines, program rules, and other policies referenced by Litera, form the entire agreement between you and Litera regarding your use of the Platform.
